1996/97 BUDGET INITIATIVE: DVA TO PAY DSS AGE PENSION TO DISABILITY PENSIONERS INSTRUMENT OF DELEGATION

Summary

Purpose of instruction

The purpose of this instruction is to:

  • explain the Instrument of Delegation that relates to the above initiative; and
  • attach the Instrument for reference.

Instrument signed

The Instrument and the Schedules that form part of the Instrument, were signed by the Secretary of Social Security, Dr David Rosalky on 19 March 1998.

Purpose of Instrument

Instrument 731 delegates powers under the Social Security Act 1991 (SSA) to certain DVA staff (Schedule B).  This delegation of power enables DVA officers to administer the SSA as it relates to age and wife pensions (Schedule A).

Structure of Instrument

Overview of structure

The Instrument is divided into 3 parts.  Expanded below, these parts are:

  • Instrument number 731;
  • Schedule A; and
  • Schedule B.

Instrument Number 731

The actual Instrument explains that the Secretary delegates certain powers (as noted in Schedule A) under section 1299 of the Social Security Act 1991, to the DVA officers shown in Schedule B.

Schedule A

Schedule A is a spreadsheet that lists every relevant provision of the SSA, alongside the Office Categories that have had powers under that provision delegated to them.

Schedule B is a document that lists which officers are included in each of the Office Categories.

Selection of provisions

Provision selection

On first impressions, it may seem that there is no logic to the provisions of the SSA that have been selected to be delegated under the Instrument.  There are in fact a number of criteria that predetermine whether a provision requires delegating or not.

Criteria

Whether a provision of the SSA is delegated may be affected by one or all of the following.  Whether:

  • the Secretary of DSS is able to delegate the provision- some provisions are not able to be delegated (refer section 1299 SSA);
  • the provision operates under it's own force; or
  • the provision is just an information or setting up provision.

Currency of provisions

Instrument 731 generally delegates the same provisions to DVA staff that are delegated to Centrelink staff who administer age and wife pensions.  Prior to signature by the Secretary, the Instrument was reviewed for currency.  Any superfluous provisions detected were omitted from Instrument 731.  Generally, they were previously delegable provisions that had become superfluous due to ongoing changes to the SSA.

Noteworthy provisions

Introduction

Whilst there is no value in detailing every delegated provision in Instrument 731, there are some points worth noting.

Deeming

DVA: Under the VEA, certain high level DVA officers have been delegated the authority, by the Minister for Veterans' Affairs, to make specific exemptions relating to the income test deeming provisions.

DSS:  DSS Legal Services Branch has advised that the Minister for Social Security does not delegate any of her section 1084 SSA deeming exemption powers.

Office Category 2 delegations

Officers included in Office Category 2 have been specifically delegated the power to release protected information that is in the public interest, under paragraph 1314(1)(a) SSA.  OC 2 officers should take note of Attachment C.

Minister's Guidelines: The scenarios outlined at Attachment C basically restate the Minister's Guidelines on this topic.  A copy of these guidelines will provided by DSS Legal Services Branch and will be held in the National Office, Executive Support Unit, Compensation and Support Division.

Office Categories

Definition

An Office Category is a category that lists by level, the officers with delegated authority in that category.  It also lists the area in which those delegated officers work.

Comparison to DVA

This differs to the DVA method of delegation, which is done by position number rather than by level

Work areas

To ensure that all relevant staff were delegated the authority they need, DSS included staff in both Income Support and Compensation areas in the office categories.  SA SO also have select staff in Health and Community Services included with Income Support and Compensation staff.


Instrument amendments required from time to time

Amendments

In the event that amendments are required to the Instrument, the Department of Social Security Legal Services Branch must be advised.

For example

In particular, if the name of the work areas noted in the Office Categories shown at Attachment B change, the Instrument must be amended to reflect this change.

SO Procedure

To ensure the Instrument is up to date, State Offices should follow the procedure below, in the event that an amendment is required.

NO procedure

National Office must advise the DSS Legal Services Branch of any changes that may affect the Instrument, so that amendments can be made if required.  After receiving advice from an SO, follow these procedures.

I, David Marcus Rosalky, Secretary to the Department of Social Security, DELEGATE under section 1299 of the Social Security Act 1991 (the Act) as follows to each officer holding, or for the time being performing the duties of an office in the Department of Veterans' Affairs included in an office category specified in Schedule B to this instrument, those of my powers under the provisions of the Act as enumerated in the relevant rows and columns of Schedule A but subject to any limitations described in the delegation key appearing in Schedule A.

COMMONWEALTH OF AUSTRALIA

Social Security Act 1991

Certificate under paragraph 1314(1)(a)—Disclosure of Information in the Public Interest

I, Dr Jeffrey A Harmer, Acting Secretary to the Department of Social Security having, under section 1295 of the Social Security Act 1991 (the Act), the general administration of the Act, REVOKE all previous certificates in force under paragraph 1314(1)(a) of the Act made prior to the commencement of the Commonwealth Services Delivery Agency Act 1997 and in relation to the Department of Social Security, and, under that provision CERTIFY that it is necessary in the public interest that information about a person held in the Commonwealth Services Delivery Agency (the Agency) and acquired by an employee of the Agency in the performance of his or her functions or duties or in the exercise of his or her powers under the Act or the Farm Household Support Act 1992, may be disclosed:

(a)in the class of cases specified in Schedule A to this certificate;

(b)for the purposes specified in Schedule A to this certificate;

(c)by employees of the Agency occupying or for the time being performing the duties of the positions specified in Schedule B to this certificate; and

(d)to the persons, organisations or authorities etc. specified in Schedule A to this certificate in relation to each class of case.

2.In deciding whether to disclose information under this certificate, employees of the Agency must have regard to the Guidelines issued from time to time by the Minister for Social Security under paragraph 1315(1)(a) of the Act, the Explanatory Statement to those Guidelines, and any Manual of Instruction or National Instruction issued for the purpose of disclosure of information under paragraph 1314(1)(a) of the Act.

Attachment C- Secretary's Certificate, Continued

1.Information not available from another source

(1).Where information requested about a person:

(a)is held by the Agency; and

(b)cannot be reasonably obtained from a source other than the Agency; and

(c)the person or organisation seeking the information has an interest in obtaining the information; and

(d)in the case of an organisation, the request for the information is made by a senior officer of that organisation;

then, subject to subclause 1(2) and 1(3), the information about the person may be disclosed to the person or organisation requesting the information.

(2).The relevant information is unable to be disclosed otherwise under subsection 1314(1) of the Social Security Act 1991.

(3).Subject to clause 10, a condition mentioned in clauses 2 to 9 is satisfied.

2.Enforcement of criminal law

Subject to subclause 10(2) and 10(3), information about a person may be disclosed to a law enforcement officer of a State or Territory where it is reasonably necessary for:

(a)the enforcement of the criminal law; or

(b)a law imposing a pecuniary penalty; or

(c)the protection of the public revenue.

3.Assault or threatened assault/damage to Commonwealth property

Where a person has:

(a)assaulted or threatened an employee of the Agency in the performance of the employees duties or as a result of the performance of the employees duties; or

(b)assaulted or threatened another person in or on premises occupied by the Agency; or

(c)deliberately damaged Commonwealth property;

information about the person may be disclosed to a law enforcement officer of a State or Territory.

4.Offences involving private property in Agency offices

Where an employee of the Agency has:

(a)witnessed an incident which involved the private property of the employee, another employee or a customer of the Agency;

(b)the incident resulted in the private property being stolen or damaged; and

(c)the person who allegedly committed the incident is a customer of the Agency;

information about the person may be disclosed to a law enforcement officer of a State or Territory if it is unable to disclosed otherwise.

5.Serious threat to life and health

Subject to subclause 10(1), where there are reasonable grounds for believing that the disclosure of information about a person is necessary to prevent or lessen a serious and imminent threat to the life or health of a person then information held by the Agency may be disclosed.

6.Persons escaped from custody

Where a person has escaped from custody, information may be disclosed to a relevant law enforcement officer of a State or Territory.

7.Abducted, missing or deceased persons

Subject to subclause 10(1), where a person is a deceased person or a missing person or an abducted person, information about the person may be disclosed to:

(a)a court, coronial enquires, Royal Commission, Department, or any other authority of a State or Territory in relation to the death or the whereabouts of the person; or

(b)another person to assist in locating a relative, friend, beneficiary or next-of-kin of the person; or

(c)assist a relative, friend, beneficiary or next-of-kin of the person;

unless there are reasonable grounds for believing that the deceased, missing or abducted person does not or would not want the information disclosed.

8.Mistake of fact in administration of program

Information about a person may be disclosed to correct a mistake of fact in relation to the administration of a program by the Agency where the person concerned has authorised the publication of the incorrect information.

9.Homeless young persons

(1).For the purposes of this clause, a homeless young person means a person who:

(a)is under the age of 18 years; and

(b)has claimed a payment from the Agency where the payment depends upon the person being a homeless person.

(2).Subject to subclause 9(8) and 10(1), where a homeless young person is either:

(a)under the age of 15 years; or

(b)under the age of 18 years and in the care of a welfare authority of a State or Territory because of the operation of the law of a State or Territory or of an order of a court;

any or all of the following information may be disclosed to a welfare authority of a State or Territory about the homeless young person:

(c)the person's name;

(d)the person's date of birth;

(e)the person's address or other current contact details about the person;

(f)that the person is homeless; and

(g)the date and place where the person claimed a payment.

(3).Subject to subclause 9(8) and 10(1), where it is clear that the disclosure of information is necessary to prevent or lessen a serious and imminent threat to the life or health of a homeless young person, the circumstances of that threat may be disclosed to a welfare authority of a State or Territory, in addition to any information disclosed under subclause 8(2).

(4).Subject to subclause 9(8) and 10(1), for the purpose of assuring a parent or the parents of a homeless young person that the person has been or is in contact with the Agency, that fact and the date of the most recent contact with the Agency, may be disclosed to the parent or the parents.

(5).Subject to subclause 9(8) and 10(1), for the purpose of verifying the circumstances by which a homeless young person may be qualified for a payment by the Agency, where verification involves contacting a parent or the parents of the person to confirm whether the person is able to live at the home of the parent or parents, as the case may be, information about the person may be disclosed to the parent or the parents.

(6).Subject to subclause 9(8) and 10(1), information about the homeless young person may be disclosed to the parent or the parents of the person but only for the purpose of facilitating a reconciliation between the person and the persons parent or parents, as the case may be.

(7).Subject to subclause 9(8) and 10(1), where a homeless young person has not had any contact with the Agency, information may be disclosed to the parent or the parents that the person has not had any contact with the Agency.

(8).Information under this clause about a homeless young person may only be disclosed if, and only if, its disclosure does not result in harm to the homeless young person.

10.Special requirements

(1).Special regard must be had to any situation in which there is, or may be:

(a)child abuse; or

(b)domestic violence;

where the person concerned may be unable to bring their circumstances to notice because of:

(c)age; or

(d)incapacity; or

(e)social, cultural or family circumstances; or

(f)for any other reason.

(2).Information must not be disclosed under clause 2 unless it is a matter of importance such as:

(a)a serious criminal offence; or

(b)a substantial pecuniary penalty; or

(c)a significant effect on public revenue.

(3).For the purpose of clause 2, the criminal law means the criminal law of any place in Australia, and includes the criminal law of a place outside Australia if, and only if, it is appropriate to recognise that criminal law under any extradition arrangements to which Australia is a party.
