Statements of Principles

Osteoarthritis - Leg amputation or asymmetric gait Factor

In the Statements of Principles for osteoarthritis the RMA has specified that having an amputation involving either leg; or having an asymmetric gait can be a contributing factor for a joint of the lower limb only.

The RMA defines a joint of the lower limb to mean "the hip, knee, ankle, sacro-iliac joint or any joint of the foot".

Note:  To apply this factor you do not need to establish which side is affected by either an amputation, or an asymmetric gait (for example if a particular leg is favoured due to a difference in height of the legs). The factor is applicable if they have either of these conditions and the osteoarthritis is to a lower limb as specified.

Amputation or Asymmetric Gait
Preliminary questions [41640]

41641 there is some evidence that a leg amputation or asymmetric gait may be a factor in the development or worsening of osteoarthritis.

41845  the veteran has claimed osteoarthritis of a relevant joint or joints for leg amputation or asymmetrical gait.

or

41847   the veteran has claimed osteoarthritis of an unspecified relevant joint or joints for leg amputation or asymmetrical gait.

41691  the veteran has osteoarthritis of a joint of the lower limb.

41642 the veteran had a leg amputation or asymmetric gait at some time.

41643 the veteran had osteoarthritis of a joint of the lower limb only.

41644  the veteran has established the causal connection between a leg amputation or asymmetric gait and VEA service for the condition under consideration.

41646   the veteran has established the causal connection between the leg amputation or asymmetrical gait and VEA service for the clinical onset of the condition under consideration.

41662  the veteran has established the causal connection between the leg amputation or asymmetrical gait and operational service for the clinical onset of the condition under consideration.

or

41663  the veteran has established the causal connection between the leg amputation or asymmetrical gait and eligible service for the clinical onset of the condition under consideration.

or

7334     the clinical onset of the condition under consideration occurred after the end of the veteran's last period of VEA service.

7335     the condition under consideration permanently worsened.

41648   the veteran has established the causal connection between the leg amputation or asymmetrical gait and VEA service for the clinical worsening of the condition under consideration.

41666  the veteran has established the causal connection between the leg amputation or asymmetrical gait and operational service for the clinical worsening of the condition under consideration.

or

41667  the veteran has established the causal connection between the leg amputation or asymmetrical gait and eligible service for the clinical worsening of the condition under consideration.

Clinical onset and operational service [41662]

41945 the veteran had the leg amputation or asymmetric gait for at least three years before the clinical onset of osteoarthritis of a lower limb joint, as a causal result of operational service.

41946 the leg amputation or asymmetric gait, on operational service, for at least three years before the clinical onset of osteoarthritis, was due to the veteran's serious default, wilful act or serious breach of discipline.

Clinical onset and eligible service [41663]

41947 the veteran had the leg amputation or asymmetric gait for at least five years before the clinical onset of osteoarthritis of a lower limb joint, as a causal result of eligible service.

41948 the leg amputation or asymmetric gait, on eligible service, for at least five years before the clinical onset of osteoarthritis, was due to the veteran's serious default, wilful act or serious breach of discipline.

Clinical worsening and operational service [41666]

41949 the veteran had the leg amputation or asymmetric gait for at least three years before the clinical worsening of osteoarthritis, as a causal result of operational service.

41950 the leg amputation or asymmetric gait, on operational service, for at least three years before the clinical worsening of osteoarthritis, was due to the veteran's serious default, wilful act or serious breach of discipline.

Clinical worsening and eligible service [41667]

41951 the veteran had the leg amputation or asymmetric gait for at least five years before the clinical worsening of osteoarthritis, as a causal result of eligible service.

41952 the leg amputation or asymmetric gait, on eligible service, for at least five years before the clinical worsening of osteoarthritis, was due to the veteran's serious default, wilful act or serious breach of discipline.
