Sleep apnoea - Disorder of cervical cord or brain stem or cerebrum or extrapyramidal system Factor

RMA definition

The RMA defines a central nervous system disorder as “a condition such as cerebrovascular accident, Parkinson’s disease, multiple sclerosis or Alzheimer’s disease”.

The upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system affects various parts of the brain.

Establishing the presence of a central nervous system disorder

These are serious conditions and if a veteran suffered from such a disorder it would be documented in the medical records.  However, specific medical advice will be necessary to establish or confirm that the veteran’s particular nervous system disorder involves the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system.

Preliminary questions [28084]

28085 there is some evidence that a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system may be a factor in the development or worsening of the condition under consideration.

28086 the veteran had a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system at some time.

28087  a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system means a condition such as cerebrovascular accident, Parkinson's disease, multiple sclerosis, or Alzheimer's disease.

28088  the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and VEA service for sleep apnoea.

28089 the veteran had the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, at the time of the clinical onset of the condition under consideration.

28090   the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and VEA service for the clinical onset of sleep apnoea.

28093  the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and operational service for the clinical onset of sleep apnoea.

or

28094  the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and eligible service for the clinical onset of sleep apnoea.

or

7334     the clinical onset of the condition under consideration occurred after the end of the veteran's last period of VEA service.

7335     the condition under consideration permanently worsened.

28091 the veteran had the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, at the time of the clinical worsening of the condition under consideration.

28092   the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and VEA service for the clinical worsening of sleep apnoea.

28095  the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and operational service for the clinical worsening of sleep apnoea.

or

28096  the veteran has established the causal connection between the central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system and eligible service for the clinical worsening of sleep apnoea.

Clinical onset and operational service [28093]

28097  the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related to operational service.

Clinical onset and eligible service [28094]

28098  the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related to eligible service.

Clinical worsening and operational service [28095]

28097  the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related to operational service.

28099 the clinical onset of the condition under consideration occurred prior to that part of operational service to which the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related.

Clinical worsening and eligible service [28096]

28098  the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related to eligible service.

28100 the clinical onset of the condition under consideration occurred prior to that part of eligible service to which the identified illness or injury, a central nervous system disorder involving the upper or mid cervical cord, brain stem, cerebrum or extrapyramidal system, is causally related.
