Intervertebral disc prolapse - A penetrating injury to a disc or adjacent vertebral body Factor

RMA Definition

The RMA has defined a penetrating injury to the relevant disc or adjacent vertebral body to mean "piercing of the relevant disc or adjacent vertebral body by objects such as a bullet, knife or needle".

The adjacent vertebral body is situated above or below the relevant disc. It would be expected that this would be a serious condition requiring almost immediate hospitalisation. However, the RMA definition does not preclude the possibility of a relatively minor penetrating injury, such as an accidentally placed needle into the disc.

Preliminary questions [23086]

25134 there is some evidence that a penetrating injury to an intervertebral disc or its adjacent vertebral body may be a factor in the development or worsening of the condition under consideration.

23087 the veteran has had a penetrating injury to an intervertebral disc or its adjacent vertebral body at some time.

23088 the veteran has had a penetrating injury to side and site of the body or its adjacent vertebral body at some time.

23089  the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and VEA service for intervertebral disc prolapse.

23094   the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and VEA service for the clinical onset of intervertebral disc prolapse.

23096  the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and operational service for the clinical onset of intervertebral disc prolapse.

or

23097  the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and eligible service for the clinical onset of intervertebral disc prolapse.

or

7334     the clinical onset of the condition under consideration occurred after the end of the veteran's last period of VEA service.

7335     the condition under consideration permanently worsened.

23095   the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and VEA service for the clinical worsening of intervertebral disc prolapse.

23098  the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and operational service for the clinical worsening of intervertebral disc prolapse.

or

23099  the veteran has established the causal connection between the penetrating injury to an intervertebral disc or its adjacent vertebral body and eligible service for the clinical worsening of intervertebral disc prolapse.

23100 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body on operational service.

25428 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body on operational service within the 24 hours before the clinical onset of the condition under consideration.

23101 the penetrating injury to side and site of the body or its adjacent vertebral body on operational service within the 24 hours before the clinical onset of the condition under consideration was due to the veteran's serious default, wilful act or serious breach of discipline.

or

23102 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body because of an illness or injury which is identifiable.

25429 the penetrating injury to side and site of the body or its adjacent vertebral body due to the identified illness or injury occurred within the 24 hours before the clinical onset of the condition under consideration.

23104  the identified illness or injury which caused the penetrating injury to side and site of the body or its adjacent vertebral body is causally related to operational service.

Clinical onset and eligible service [23097]

23105 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body on eligible service.

23106 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body as a causal result of eligible service.

25430 the veteran had a penetrating injury to side and site of the body or its adjacent vertebral body as a causal result of eligible service, within the 24 hours before the clinical onset of the condition under consideration.

23107 the penetrating injury to side and site of the body or its adjacent vertebral body as a causal result of eligible service within the 24 hours before the clinical onset of the condition under consideration was due to the veteran's serious default, wilful act or serious breach of discipline.
