10.12.16 Failure to comply with MVCS requirements

If the MRCC is satisfied that a person has, without reasonable excuse:

  • knowingly provided false or misleading information in connection with their application; or
  • knowingly failed to comply with a provision of the MVCS;

the MRCC may determine that the person is not eligible under the MVCS for a period of five years from the time the delegate determines that the person has failed to comply. In making such a determination the MRCC must take account of the significance of the provision of false or misleading information or the failure in respect of the provision of compensation under the MVCS and the impact on the person.
