1.1 Legislative responsibility

The Aged Care Act 1997 and Principles govern all aspects of residential care, flexible care and home care packages. The Aged Care legislation sets out matters relating to the planning of services, the approval of service providers and care recipients, payment of subsidies and the responsibilities of service providers.

Note: The Aged Care (Transitional Provisions) Act 1997 sets out the arrangements for fees, subsidies and payments which are preserved for aged care recipients who entered care before 1 July 2014. References to Aged Care legislation are intended to cover the relevant Acts as required and continuing care recipients is the term used to refer to pre 1 July 2014 residents.
