DEFENCE COMPENSATION ADVICE - NO 38
">Commonwealth Employees Rehabilitation And Compensation Act 1988
">IMPLEMENTING AAT DECISIONS
">1. It has come to our attention that some regions are not actioning AAT decisions promptly. When an AAT decision and the compensation file are sent to the region, the regional office should write to the claimant informing them of the contact officer and asking for any information that will be necessary for the calculation of an entitlement.
2. Whilst the AAT does not require that their decisions be implemented within a set time frame, claimants who have had favourable decisions made by the AAT expect, not unreasonably, to receive their compensation entitlement within a month or so of the decision being handed down. It is considered appropriate that a claimant should receive his or her entitlement 28 days after the file has been received in the regional office.
3. If this does not prove to be possible, the claimant should receive a written explanation for the delay.
4. Please ensure that all action officers are familiar with the above and treat all such cases in the manner described.
5. If you have any enquiries, please contact Gabrielle Lawler on (06) 266 8631.
