Waiving overpayments should never be viewed as a means of “getting rid of” outstanding recovery accounts, irrespective of age or amount.  Where a person received money to which he or she is not entitled, recovery action must be commenced except in the most exceptional cases.

Money provided for compensation entitlements is from government funds and should be recovered responsibly where overpayment does occur.

However, in a small number of cases, waiver will be applicable.

As the waiver delegation rests with the CEO, it is essential that a complete and comprehensive background is provided in support of any request to waive an overpayment.

Prior to submitting any request to the CEO, the case must be discussed with the state manager and he or she should review any documentation to be provided to the CEO.  The state manager will need to endorse any prepared documentation and then forward it to the Operations Group.
