Under no circumstances should a value judgement be placed on a debtor's individual financial particulars. This level of personal subjectivity is inappropriate and breaches section 72 of the SRC Act.
Information received on the Statement of Financial Circumstances form (see below) should not be queried unless there is a clear discrepancy or possible error with what has been contended.
Even then, while clarification of what has been provided may be sought, any expenses for personal requirements reconfirmed by the debtor should not be questioned further.
Should any claims manager experience difficulty in this area, the claim and request for write off or waiver should be passed on to the state manager for completion.
