“Subject to this Division, if the former employee's total benefit immediately before the commencing day was equal to or more than 70% but less than 95%, of his or her normal weekly earnings as at that day, the amount of compensation payable per week to the former employee under this Act is an amount equal to the employee's 1971 amount.”

This section relates to former employees who had a 1971 benefit of compensation plus superannuation which equalled between 70 and 95% of their NWE.

In these cases, the compensation entitlement when the new Act came in was originally set at the amount the employee was receiving under the old Act, and 'frozen' until such a time as 70% of their NWE equalled or exceeded this amount.
