“Subject to this Division, if the former employee's total benefit immediately before the commencing day was equal to or more than 95% of his or her normal weekly earnings as at that day, the amount of compensation payable per week to the former employee under this Act is the amount that, when added to the former employee's superannuation amount, results in a combined benefit equal to 95% of those normal weekly earnings.”

This section relates to former employees who had a 1971 benefit of compensation plus superannuation which was equal to or greater than 95% of their NWE.

Where the benefit was greater than 95%, it was reduced to that figure when the new Act commenced on 01/12/88, and 'frozen' until such a time as 70% of their NWE equalled or exceeded this amount.
