At 01/12/88, former employees' entitlements were affected as follows:

  • each employee not in receipt of superannuation had his or her weekly payments compared to his or her Normal Weekly Earnings as calculated under the 1988 Act (what he or she would have been earning if still employed);

  • each employee receiving superannuation had the total of his or her compensation and superannuation amounts compared to his or her Normal Weekly Earnings.

There were three possible outcomes:

  • where the amount being received was more than 95% of NWE, entitlements were reduced to 95% and then 'frozen';

  • where the amount being received was between 70% and 95% of NWE, entitlements continued unchanged and 'frozen'; and

  • where the amount being received was less than 70% of NWE, entitlements were increased to 70%.

Thus, no former employee should receive more than 95% of NWE or less than 70% of NWE.
