"An amount of compensation payable under this section is payable:

(a)to, or in accordance with the directions of, the employee;

This means, where an employee lodges an account, he or she is directing Comcare to make payment to the service provider.  Alternatively, where he or she provides a receipt, he or she is directing Comcare to make payment to him or her.

(b)if the employee dies before the compensation is paid and without having paid the cost referred to in subsection (1) and another person, not being the legal personal representative of the employee, has paid that cost - to that other person; or

This covers people who have made payments on behalf of the employee (excluding the employee's legal representative).

(c)if that cost has not been paid and the employee, or the legal personal representative of the employee, does not make a claim for the compensation - to the person to whom that cost is payable."

This is a rare circumstance, where the employee dies after a service has been provided, yet before a claim for compensation has been made.

Payment can be made to the provider of the service despite there being no claim.  However, it still must be decided whether liability to pay compensation would be found, before meeting the cost.
