“Subject to this Division, if the former employee's 1971 amount was equal to or more than 95% of his or her normal weekly earnings as at the commencing day, the amount of compensation payable per week to the former employee under this Act is an amount equal to 95% of those normal weekly earnings.”
This section relates to former employees who were in receipt of a compensation benefit under the 1971 Act which was equal to or greater than 95% of their NWE.
Where the benefit was greater than 95% NWE, it was reduced to that figure and then frozen (for the time being). Section 132 (5), which is detailed below, explains what happened to these cases over time.
