From 21 April 2025, the review pathway for most claims under all 3 Acts is the Veteran’s Review Board (VRB). 

All applications to the VRB need to be made directly to the VRB, not through DVA.

The appeal process and how a client can lodge an appeal depends on the date that the claim was determined. 

The process and need to involve other business areas will depend on the circumstances of the review.  

Liability decisions under the VEA can only be revoked on the grounds that are set out in section 31 of the VEA.  These include:

Depending on the precise circumstances, the provisions set out in Section 31 of the VEA may be able to be applied to revoke or vary the acceptance of liability and the granting of disability compensation payment (DCP) grant, war widow(er)’s pension or orphan’s pension if it is identified that original decision was incorrect or flawed.

Where it is identified an original decision was manifestly incorrect or in some way flawed, it may be necessary to make a new determination. This action is supported by policy and referred to as a review own motion.
