Overpayments for deceased employees occur when late advice of death is provided to Comcare.  This means that existing payments made to the employee extend beyond the time the benefit applies (which should only be up to and including the end of the payment period in which the employee died).

Example

An employee is paid a one off incapacity payment spanning four weeks, which essentially constitutes 2 fortnightly periods.  The one off status of the determination means the employee receives one payment for four week's incapacity (not two payments, as would occur with recurring determinations).

He dies in the second week of the first fortnightly period.

Eligibility may continue until the end of the first fortnightly period, irrespective of when, within that period, the employee died.

However, the second fortnightly payment period must be recovered.
