With the commencement of the Social Services Consolidation Act 1947, section 115 of that Act provided that sickness benefits would be affected by compensation payments, where they were both paid for the same condition and the same period.

Section 52 of the 1971 Act allowed Comcare to have regard to the payment of invalid pensions from the Department of Social Security (DSS) when determining weekly compensation payments.

The Social Security Act then went through a number of legislative amendments between August 1982 and May 1987.  These amendments extended compensation recovery provisions to most benefits payable under the Social Security Act.

While the SRC Act does not provide for any equivalent provisions to those in the Social Security Act (including invalid pensions), the entire legislation responsible for repayment of DSS benefits is within Part XVII of the Social Security Act.
