The Guide to APS Pay and Conditions of Employment (The Guide) provides guidelines to employer Human Resources Sections on the application of the Public Service Act and other related legislation regarding employment and service conditions.
Part 2 of The Guide deals with compensation and accident leave.
Section 5.1 and 5.2 of The Guide provides that:
(5.1)"Employees who have already started work on the day of their injury are regarded as being on duty for that day and are paid normal salary. Compensation Leave starts of the next working day."
(5.2)"Employees who are injured while travelling to work are not eligible for salary for that day, because they have not started work. In this case, Compensation Leave starts from the date of injury."
This means that, where an employee has commenced work and then later has to leave due to a work related injury, he or she is entitled to full salary for that day, hence requiring no compensation payment.
Compensation leave starts the next working day.
However, if the employee is injured before starting work, compensation leave will commence on the date of injury.
This applies across the board to Public Service employees. Additionally, there are usually equivalent awards outside The Guide relating to employees covered by workplace and other agreements, providing the same employment conditions.
