- 12.5 Aggravation of SRCA Conditions
External
Under subsection 7(2) of the CTPA, t — he MRCA applies to a person's claim for aggravation of a — n accepted SRCA condition if two criteria are met:
- t — he aggravation occur — red on or after 1 July 2004; and
- t — he aggravation relates to service rendered by the person on or after 1 July 2004.
Both criteria must be met before the MRCA can apply to an aggravation of a SRCA condition. T — he MRCA does not apply to an aggravation of a SRCA condition if the aggrava — tion occurred after 1 July 2004 and the aggravation only relates to defence service rendered before 1 July 2004.
It is important to note that liability for clinical onset of the original condition continues to exist under the SRCA even if the MRCA applies to an aggravation of that condition.
