Section 41 of the 1971 Act provides for compensation where a member suffered severe and permanent facial disfigurement before 1 December 1988.

Where the facial disfigurement occurred, or became permanent, after 1 December 1988, compensation is payable under s 24 of the SRC Act in an amount calculated under Table 4.2 (Facial Disfigurement) of the Approved Guide.

This question is testing s 41(2)(a) which provides that compensation is not payable where the disfigurement would not be severe if the member underwent suitable medical treatment; s 41(2) states:

41(2)For the purposes of this section-

(a)facial disfigurement shall not be taken to be severe where, if the employee underwent suitable medical treatment, the disfigurement would not be severe;
