This question asks the assessor to identify whether the medical condition which is the subject of the claim is:
- an injury or a disease; or
- an aggravation of an injury or a disease.
In this context, “injury” mean an injury and does not bear its other meaning under the SRC Act whereby it is a generic term for the claimed medical condition, and encompasses both injury and disease.
It is important to determine correctly whether the condition is an injury or a disease, because the causation tests for disease and injury are different, the rules for establishing date of injury are different, and some other elements of liability may apply only to a disease (eg. s 7(7) - wilful and false statement upon employment) or only to an injury (eg. s 6(1)(b) journey claims).
