Under the Safety, Rehabilitation and Compensation Act 1988, an entitlement to compensation arises in respect of two different types of loss:
- s 14: compensation in respect of an injury suffered by an employee;
- s 15: compensation for loss of, or damage to, property used by the employee.
It is important to identify at the outset whether compensation is sought in respect of an injury, or in respect of property loss or damage, because the statutory rules for determining liability (including causal requirements) are different in each case.
