Cessation of entitlement after redemption

A redemption payment under s 30 has the effect of ceasing ongoing entitlement to weekly incapacity payments from the day after which the determination is made (subject to s 31).  This is provided for in s 23(3).  No other entitlements are affected by redemption.  A client remains entitled to receive compensation for medical expenses, permanent impairment, rehabilitation assistance, household services, etc.

There is no equivalent to s 23(3) or s 31 in respect of redemptions under s 137.  Accordingly a former employee is unable to access additional weekly incapacity payments if their degree of incapacity worsens after redemption.  They may continue, however, to be entitled to receive compensation for medical expenses, rehabilitation assistance, household services, etc, in accordance with Part X..
