The client's expectation of life, according to the Australian Life Tables, is relevant to the question of redemption of compensation for incapacity under s 137 in Part X of the SRC Act. Section 137, which applies only to “former employees”, permits redemption of weekly payments of compensation for incapacity if:
- weekly payments of compensation for incapacity are being made under Part X to a former employee;
- the amount of the weekly payment is less than the prescribed maximum (currently $79.43 pw; $? pw from 1 July 2003);
- the degree of the employee's incapacity is unlikely to change; and
- the former employee makes a written request for redemption.
Unlike redemption under s 30, redemption under s 137 is activated by a request by the former employee and will not otherwise be considered by the determining authority.
