These employees no longer work for the Commonwealth, through resignation or retirement after 01/12/1988.  The Date of Injury may be pre 01/12/1988, but the date of separation is the important issue here.

NB  The difference between ex and former employees is that ex employees are not entitled to compensation for incapacity once they turn 65 years of age.  Up to age 65, these employees receive incapacity payments under sections 19, 20 and 21 of the SRC Act.

Former employees continue to be paid an entitlement past 65 years of age, taking into account a 5% dollar reduction in compensation for every year between 01/12/1988 (the date the current Act commenced) and their 65th birthday.
