There is no mandatory requirement under the 1971 Act for employees to advise when common law or third party action has commenced.
However, as it is in the interests of the plaintiff to provide the Court with details of all monies paid to date for the condition for which action is being taken, Comcare is usually advised once action has started.
This initial advice allows a record to be kept of how settlement is proceeding and when it is likely that the case will be decided. It is most important to record these details.
In this regard, the 'CCOM.CM' (Create Claim Comments) function should be used to enter any information for not only initial advice from the employee, but also any ongoing issues relating to settlement processes.
