In cases where there is more than one dependant making a claim (such as a spouse and two children), where whole dependency can be established, the full $168,937.90 is apportioned between all parties.

The spouse will receive 75% or more of the total amount, and each of the children will receive the following:

  • 1 child10% (remainder to spouse);

  • 2 - 5 children5% each (remainder to spouse);

  • More than 525% divided between all children.

In cases where there are dependants other than the spouse/children to share in the lump sum, the relative dependence of these claims will need to be assessed.

These claimants will be required to demonstrate the amount of money, or form and amount of economic support they received periodically from the deceased employee.

The more information that is provided, the easier it is to clearly see whether other dependants were wholly supported economically by the employee.
