“Where claims for compensation under this section are made by or on behalf of 2 or more dependants of a deceased employee, Comcare shall make one determination in respect of those claims.”
It is really important to ensure, as far as is practicable, that all dependants of a deceased employee are encompassed in claims for a lump sum death payment.
This is because section 17 (10) states only one determination can be issued.
All known dependants will be included within the one determination, but any who do not claim prior to the determination being made, will miss out on the lump sum entitlement, with the complete entitlement already being divided up between known dependants.
