This subsection should not normally be an issue.
It says:
“An employee shall not be required to undergo an examination under this section at more frequent intervals than are specified by the Minister by notice in writing.”
A special Gazette notice was issued by the Minister on 30/11/1988, providing a time frame for examination intervals.
The Gazette states:
“For the purposes of subsection 57 (6) of the Act, where an employee is in receipt of weekly payments of compensation and has been subject to an assessment under section 36 of the Act, the intervals between examination under this section by the same practitioner shall not be less than one month.”
Please note that this time frame only refers to examinations where a rehabilitation Initial Needs Assessment has also been conducted. There is currently no gazetted time limit for the frequency of section 57 examinations in other cases.
