Comcare Australia may not release information to any third parties EXCEPT:

  • Where the claimant has been made aware, or would usually be aware, that a release to that third party may occur.

  • With the claimant's consent.

  • To prevent a serious and imminent threat to a person's life or health.

  • Where the release is required or authorised by law. (This includes where it is released to the employing Agency under Section 59 of the CERC Act.)

  • Where it is necessary for the enforcement of criminal or revenue law (in which case a note of the release must be made on file).

Once information has been disclosed to a third party, there is then an obligation on that party not to use or disclose the information for any other purpose than that for which it was given.
