- To provide operational policy and procedures on waiving the recovery of overpayments under section 114 D of the Safety, Rehabilitation and Compensation Act 1988 (the Act).
- If Comcare waives its rights to recover, this is a permanent bar to recovery of the debt – the debt effectively ceases to exist. If Comcare writes off a debt, this means an administrative decision has been made that, in the circumstances, there is no point in trying to recover the debt. In law however, the debt still exists and may later be pursued. This operational advice deals only with waiver.
