There are specific provisions in the 1988 Act to cater for pre 01/12/1988 injuries. The provisions are called 'Transitional Provisions (Part X of the Act)', and mainly have regard to the former Act, the Compensation (Commonwealth Government Employees') Act 1971.
Generally employees will not be entitled to compensation under the new Act unless they can establish that compensation would have been payable under the provisions of the Act in force at the date of injury.
Comcare no longer receives many new claims for conditions which occurred before 01/12/1988, but occasions will arise where it will be necessary to look at the provisions of the relevant repealed legislation.
