'Compensation leave' is defined in section 4 of the Act as:

“any period during which an employee is absent from his or her employment due to an incapacity for work resulting from an injury in respect of which compensation is payable under section 19 or 22.”

This definition includes all periods where an employee has an entitlement to total or partial incapacity benefits and periods covering full time redeployed employees.

Additionally, section 116 relates to both normal incapacity entitlements (section 19) and those where an employee is maintained in a hospital or similar long term nursing care (section 22).  However, it does not relate to retired employees in receipt of superannuation.
