Dear <employee title and surname>
I refer to my previous letter of <date of letter> regarding the recovery of overpaid compensation from your superannuation benefit.
Following advice from your superannuation fund (copy of letter enclosed), it has been established that an overpayment of <$ amount of overpayment> has been incurred.
The overpayment has been calculated as follows:
<details of appropriate section of the Act, compensation paid, superannuation entitlement, applicable balance and difference between what was paid and what should be paid taking into account superannuation>
EITHER
<As your fund has not yet commenced payment of superannuation to you, the fund is legally responsible for directly repaying Comcare for the overpaid amount.
However, this will not affect your overall superannuation entitlement. Any overpaid monies will be recovered from a separate superannuation lump sum amount payable by the fund for backdated entitlements between the date of retirement to date of commencement of payment of superannuation.>
OR
<However, as your fund has already commenced payment of superannuation to you, we are obliged to seek recovery of the overpaid amount direct from you.
It would be appreciated if you could arrange to have the overpaid amount repaid as soon as you can. A cheque should be forwarded to this office, made payable to 'Comcare Australia', and marked to my attention.
A response should be provided from you within 28 days of the date of this letter.>
Please contact me on <phone number> if you would like to discuss the matter further.
Yours sincerely
