3.12.6 Transition at the end of the VP period

Following the determination of the final claim for a mental health condition, Veteran Payment will continue for 42 days (6 weeks), or until an alternative payment is in place, for example, incapacity payments. In special circumstances, this 42-day period may be extended by the Commission. Special circumstances include:

  • Claim for incapacity yet to be determined: if incapacity payments are yet to be determined, or there is evidence that they will not be determined in the 42-day period following the determination of the current or former member of the ADF’s liability claim for a mental health condition, then Veteran Payment can be extended.
  • Claim for incapacity has been rejected: if incapacity payments have been rejected, then Veteran Payment can be extended to assist the current or former member of the ADF to transition to another Australian Government income support payment or return to work.

What happens if the claim for liability is accepted?

Once a liability claim is accepted the rehabilitation case should be transferred to the business as usual (BAU) process. This will not require a new R&C ISH claim, but the following steps need to be done:

  1. Enter an ISH case note advising the change to BAU, reason and date.
  2. Ensure that if a full initial needs assessment hasn’t been done, that one is completed.
  3. While not a determination, the client should be advised that their rehabilitation program now fits under the BAU model, and what this means.

What happens if the claim for liability is not accepted?

If the client’s claim for liability is not accepted, then the rehabilitation provider will be expected to assist transition the client to another service that will assist the client. The Veteran Payment can continue for up to 6 weeks after the decision to not accept liability has been made.
