Rehabilitation determinations

APS Level

Delegations of Powers & Functions under the Safety, Rehabilitation & Compensation Act 1988 (SRCA)

Referral for an assessment

Section 36 provides the power to refer a client for an assessment of capability of undertaking a rehabilitation program;

and in this section, Subsection 36(4) provides the power to suspend a client's right to compensation where a client refuses or fails without a reasonable excuse to participate in the assessment process.

APS 3 and above

Approval of rehabilitation programs

Subsection 37(1) provides the power to:

  • approve a rehabilitation program; or
  • amend a rehabilitation program; and/or
  • where appropriate close a rehabilitation program

Subsection 37(7) provides the power to suspend a client's right to compensation, where a client refuses or fails without a reasonable excuse to participate in the agreed rehabilitation program.

APS 3 and above

Approval of alterations, modifications, aids and appliances

Subsection 39(1) provides the power to approve certain alterations to a client's place of residence or workplace, modifications to a client's vehicle, any aids or appliances for the use of the client, or the repair or replacement of such aids and appliances; as reasonably required by the client.
