RMA Definition
The RMA has defined a penetrating injury to the relevant disc or adjacent vertebral body to mean "piercing of the relevant disc or adjacent vertebral body by objects such as a bullet, knife or needle".
The adjacent vertebral body is situated above or below the relevant disc. It would be expected that this would be a serious condition requiring almost immediate hospitalisation. However, the RMA definition does not preclude the possibility of a relatively minor penetrating injury, such as an accidentally placed needle into the disc.

These symptoms and signs must last for a period of at least seven days (RH) / at least ten days (BOP) following their onset; save for where medical intervention for the trauma to the relevant disc has occurred and that medical intervention involves either:

The requirements in the Statement of Principles regarding flying powered aircraft for Lumbar Spondylosis and Intervertebral Disc Prolapse now have three different requirements.
For reasonable hypothesis cases the requirement is:
Flying in a powered aircraft as operational aircrew for a cumulative total of at least 2500 hours within the ten years before the clinical onset or clinical worsening.
For balance of probability cases the requirements are:
Flying a powered aircraft for a cumulative total of at least 5000 hours within the ten years before the clinical onset or clinical worsening.
or
Flying in a helicopter as operational aircrew, for a cumulative total of at least 5000 hours within the ten years before the clinical onset or clinical worsening.
Operational aircrew now includes all other operational aircrew in addition to pilots and co-pilots, but still excludes persons who were passengers only.
The intention of the wording of the factors that do not specify operational aircrew is that they only apply to persons who are flying a powered aircraft. The evidence about the connection with lumbar spondylosis and intervertebral disc prolapse is that this only relates to pilots and co-pilots.
Where the aircraft is specified as a helicopter the whole period of flying time must be related to only flying helicopters. If the person has flown a combination of powered aircraft then the factor relating to powered aircraft applies, and the person must have been a pilot or co-pilot.
Although the RMA has not defined "powered aircraft" the term excludes any non-motorised aircraft such as gliders, hang-gliders and similar devices.
Information about the scope and nature of various service occupations is also contained in Physical requirements, duties, and workplace hazards of specific military occupations.

The RMA has defined 'high performance aircraft' as meaning "an aircraft capable of routinely sustaining a positive G force of four or more".
The first planes that were "high performance" or "high G" were the fighter planes introduced during World War II, such as Spitfires or Hurricanes. The wearing of anti G suits (to prevent loss of consciousness) became commonplace after WW2, and if worn by the aircrew, is a good indicator that the aircraft was liable to pull high positive Gs in common flight profiles. However, anti G suits would not be worn in heavy bombers, transport, helicopters etc, indicating that sustaining G forces was not an expected part of that aircraft flight profile.
With WW2 aircraft anti-G suits were not necessarily available. In these circumstances it may be necessary to look at the role of the aircraft (were they used in a fighter combat role), or if the aircraft had a number of roles, the role of the claimant (what type of missions did they fly).
The following aircraft may be considered "high performance aircraft". NOTE: this is not an exhaustive list.
Trainers
The following aircraft are not considered "high performance aircraft". NOTE: this is not an exhaustive list.
For aircraft not covered in these lists, the following site lists all RAAF/RAN aircraft:

Information may also be available from the RAAF. If you need to check whether specific aircraft were capable of routinely sustaining +4G, submit a request through DocTracker and the Single Access Mechanism (SAM) group will endeavour to obtain the information.

If there is a history of pipe smoking it will be necessary to obtain information about:
The evidence gathered should be as complete and accurate as possible. Information already held in departmental files, e.g. in previous statements and clinical notes, should not be overlooked. Conflicting evidence should be resolved.
Before a causal link between a smoking habit and service may be established, consideration must be given to Repatriation Commission Guideline CM5030 - Guideline for claims assessors on smoking and alcohol related conditions and military service [13].
Note: The SOP factor dealing with pipe smoking covers only the smoking of tobacco. It does not include non-tobacco products such as marijuana or hashish. This is because the RMA SOP factors refer to "cigarettes or the equivalent thereof in other tobacco products".

Smoking cigarettes, cigars or pipe tobacco due to VEA service need only have made a material contribution to the minimum smoking requirements specified in the Statement of Principle (SOP) (refer Kattenberg v Repatriation Commission [2002] FCA 412). It has not been possible to make changes to the smoking module in CCPS to take account of this, but for many cases this is of no consequence because service-related smoking alone is sufficient to meet the SOP requirements. However, for smoking cases that do not succeed under the CCPS smoking module, there is a contention:
· Smoking tobacco products - material contribution
This contention covers all types of smoking – cigarettes, pipe and cigars - with rulebase questions to ascertain whether or not VEA service made a material contribution to the SOP requirements. This may entail addressing issues that have already been covered in the smoking module because it has not been possible to isolate specific facts established within that module.
