7.11.6 Recovery from salary or wages

7.11.6.1Where limitation against a client's pension is impractical or attempts to negotiate a lump sum settlement or payment by cash instalments have been unsuccessful, consideration should be given to using payment notice recovery from the debtor's salary or wages. This method of recovery should be used where it is not possible to issue a payment notice to a financial institution.

7.11.6.2Payment notice action against a person's salary or wages must not be undertaken without first making genuine attempts to contact the person or the person's employer.

7.11.6.3The following details should be obtained from the debtor's employer by issuing a request under section 128 VEA:

  • full name and address of employer
  • location of employment
  • payroll number
  • gross weekly salary for the last 13 weeks
  • details of deductions made from salary/wages.
