Section 114B (3)
Section 114B(3) provides:
“Comcare ... must give to the retired employee a written notice stating that it has given a notice to the administrator of the scheme under subsection (2) and explaining how this section works.”
This will clearly indicate to the employee from the outset that there is a likelihood of overpayment and that, while the Fund will usually be in a position to make a repayment direct to Comcare on the employee's behalf, there is also the possibility that the employee will be required to make the repayment.
While it is legislated, it is also a courtesy to advise the employee as soon as possible of the potential for an overpayment. Following the above procedure allows that to occur.
