Applying Operational Advice No 164
In the past, it was common practice to raise the overpayment against the employee. However, since the amendment of the Act on 19/01/1994 to allow for the recovery of money direct from an organisation other than the employee, and introduction of Operational Advice No 164, Comcare has been able to directly approach the relevant superannuation Fund for reimbursement.
These arrangements only operate if recovery of the overpayment can be effected before the employee receives his or her first superannuation benefit payment.
If payment has been already been received by the employee, the money will need to be recovered direct from him or her.
