Recovery From The Employee

Where:

  • superannuation payment has already been received;
  • the employee has elected to defer his or her superannuation benefit; or
  • the lump sum back payment forming part of the employee's superannuation entitlement is not enough to cover the full cost of the overpayment;

the following procedures apply.

Retain copies of all communication on the claim file and/or PRACSYS.

  •       Calculate the overpayment.
  •       Set up PRACSYS superannuation details.
  •       Ensure the initial letter about overpayment (at Appendix 15) has been issued to the debtor.
  •       Negotiate repayment in one of three ways:
  •      'money in';
  •      offset; or
  •      periodic offset.
  •       Generally, except where financial difficulty applies, recover the overpayment by the same amount as it was initially paid.
  •       Create a diary to follow up receipt of 'money in' cheques.
