Negotiating With The Debtor

Small employers should initially be advised by phone:

  • that an overpayment has occurred;

  • how it has occurred; and

  • suggested methods of repayment.

This discussion may formally be followed up by letter (a sample letter is at Appendix 1) to confirm what has been explained.

While most employers, irrespective of size, will be able to afford to have overpaid monies recovered from their next cheque remittance, alternative payment methods must be provided.

In some cases, the employer may choose to issue their own cheque ('money in') to cover the overpayment.  However, it is more likely that they will either select to have money retrieved using the offset option in one lump sum or in rare cases, over a number of subsequent cheque remittances.
