Taking Recreation Leave
Leave entitlements, other than maternity leave, should not be taken during a RTWP, as it may impede progress of the return to work.
Section 116 of the Act states:
“In spite of the provisions of any other Act or an award, an employee is not entitled to be granted any kind of leave of absence with pay (other than maternity leave with pay) during, or in respect of, any period when the employee is or was on compensation leave ...”
However, under Public Service guidelines (Personnel Management Manual Volume 8, sub section 5/D), there is allowance for limited recreation leave to be taken during the hours that the employee is scheduled to be at work.

He or she could be granted 4 hours per day recreation leave and the remainder in compensation benefits. |
Periods of leave should not be granted without consultation with the case manager, who should ensure that the leave does not interrupt the rehabilitation process. As a general rule, leave should not be granted.
