Examinations Using Section 36 (3)

“The rehabilitation authority may require the employee to undergo an examination by the person or panel of persons making the assessment.”

Section 36 (3) provides employers with the power to have an employee examined as part of the assessment process.  As mentioned previously, this will usually be by an “approved rehabilitation provider”, who will report on the employee's capability of undertaking a Return to Work program and his or her specific needs.

Assessment initially involves the rehabilitation provider, the case manager, the employee and treating doctor completing Comcare's assessment forms.
