Possible compromise
Once all avenues and options have been considered, claim suspension may still apply. However, it must be remembered that suspension is a final option, and this decision cannot be made without consideration also being given to alternative strategies to suspension.
Compromise may well be an alternative:

An employee has elected not to comply with his RTWP and the departmental Case Manager recommends to Comcare that the compensation claim be suspended. |

However the decision is made by the claims manager to continue to make benefit payments for the next three months, on the proviso the employee then undertakes any rehabilitation program initiated by the Case Manager. |
Once a decision has been made to suspend the claim, the claims manager must issue a formal letter to the employee, advising that Comcare has been notified of non-compliance.
The repercussions of non-compliance should be clearly spelt out to the employee, with both suspension provisions and suspension dates indicated. In all cases, the employee's right to a review of the potential decision to suspend should be clearly provided.
