Where A Reconsideration Is Requested

Requesting a reconsideration of the decision to make a lump sum PI payment needs to be lodged within 30 days of the date of the decision.

Where a request is received (usually by the employer), section 26 (4) applies.  This section ensures that payment time restrictions are waived where a reconsideration request is received.

By advising the employer about a prospective lump sum payment, the employer is being provided with the opportunity to object to the decision.

Failure to consult the employer may result in compensation being overpaid to the employee, should the employer successfully request a reconsideration of the decision.
