Further Deterioration

If an employee's impairment deteriorates after a final (section 24) award has been made, he or she will not be entitled to a further award unless the degree of impairment increases by at least another 10%.

This is not the case where an interim  (section 25) award has been made and there is subsequent deterioration.

Example

If an interim award of 10% was made for loss of half the normal range of movement of the ankle, and the condition then deteriorated to a loss of more than half normal range, compensation for an additional 5% impairment would be payable.
