Advising The Employee
Prior to making a payment to the employee, a letter will need to be issued advising what the calculated entitlement is.
In addition, the following points must be included:
-
the employee's right to elect to institute proceedings against the Commonwealth for NEl, as an alternative to accepting compensation payment for permanent impairment and NEL.
The employee must advise in writing of his of her intentions in this regard; and
of any formal determination made by Comcare to pay compensation for permanent impairment and NEL.
Following this letter, no payment will be made for a maximum of 30 days to give the employee an opportunity to respond. If no response is received within the 30 days, determination of the calculated amount should proceed immediately.
