Redemption For Transitional Employees (Section 137)

OPERATIONAL ADVICE No 151 Notification of S137 Entitlement

As indicated in the table on page 1, while a current employee's incapacity entitlement must be redeemed, the entitlement for a transitional employee may only be redeemed at the written request of the employee.

Likewise, Operational Advice No 151 states that where a request has not been received, but it is identified that a case is eligible for redemption, the former employee should be advised that an entitlement exists.

Such advice should provide details of how much the lump sum payment is for, what it involves (including that the calculation takes into account incapacity after 65 years of age), and other entitlements still able to be claimed (such as ongoing medical costs).
