Ability To Earn

'Ability to earn' can be defined as:

what an employee is capable of earning in suitable employment.

However, an employee's ability to earn and his or her actual earnings can vary in some circumstances.  Section 19 (4) of the Act is used to assess this and is extensively discussed below.

An employee's ability to earn (AE) determines the extent of his or her incapacity.  If an employee is able to earn, he or she cannot be classified as totally incapacitated.  Rather, he or she has a reduced work capacity.
